TERMS, CONDITIONS & SERVICE GUARANTEES
New England Gutters Inc
1. General Terms & Hold Harmless Agreement
Legally Binding Agreement
When agreeing to services to be performed by New England Gutters Inc, you are agreeing for work to be completed at the agreed-upon price.
Hold Harmless
By accepting this proposal, you agree to hold New England Gutters Inc harmless from any and all claims resulting from the work performed.
Weather & Scheduling
Scheduled jobs are subject to change due to weather or other unforeseen conditions. Scheduling in a business where productivity can be affected by weather, equipment failure, or job order changes can be difficult. We try our best to keep scheduling conflicts to a minimum, but circumstances beyond our control may affect your project start and end dates/times. You will be notified of any changes whenever possible.
Cancellation Policy
This agreement may be cancelled for any reason within 3 days of your acceptance with a full deposit refunded. In the event that you cancel the agreement beyond the 3-day period but prior to the work commencing, all deposits made to New England Gutters Inc shall be retained by the company but may be applied towards any future services performed by us.
On-Site Supervision
Every New England Gutters Inc crew has a full-time foreman on site at all times. All foremen undergo comprehensive product, technical, and safety training. We also offer dedicated on-site Management Supervision as an added service at an additional charge, whereby one of our Field Managers will be on-site for part or all of the project as agreed upon with the customer.
2. Gutter & Roof Work Terms
Gutter Cleaning Scope
Gutter cleaning does not include underground pipes, leaders, or drywell systems. If it is observed that any of these conditions exist, there will be an additional charge to power snake or reroute the leader, if necessary.
Water Damage Disclaimer
New England Gutters Inc is NOT responsible for water damage to your home resulting from gutter, roof, and/or siding work, and is held harmless against any and all such claims.
Non-Recommended Work
When a service is not recommended to be performed by us and noted as such, such work will NOT be guaranteed. These services may still be performed upon the customer's request; however, New England Gutters Inc will not be held responsible for any damages occurring before, during, and/or after the service is completed.
3. Pressure Washing & Property Condition
Property & Roof Condition
While New England Gutters Inc will make every attempt to assess conditions before starting work, it is the customer/homeowner's responsibility to ensure a safe work environment and that the property is in good enough condition to be worked on. By scheduling roof washing, the customer represents that the roof condition is safe, sound, and in good enough measure to be walked and worked on.
Pre-existing Damages
New England Gutters Inc is not responsible for damage due to improperly installed or loose siding, loose shingles, broken or open windows, improperly sealed windows, wood rot, worn or splintering wood, defective construction, improperly secured wires, loose or improperly installed gutters and leaders, or improper/insufficient caulking.
Siding Fading & Color Variances
The sun and weather bleach the color of aluminum and vinyl materials over time, causing them to fade. Pressure washing removes chalky, gritty, and failing surface materials, which may cause the faded aspects of the vinyl or aluminum to vary greatly from the original "new" color. New England Gutters Inc is not responsible for such conditions or variations. We are also not responsible for any loose mortar or pavers that may dislodge during the cleaning process.
Unremovable Stains
Some stains cannot be removed by conventional pressure washing (e.g., tree sap, well-rooted artillery fungus, stain/paint splatters, rust, and motor oil). Certain stains like rust may be removed when treated with specialized products at an additional cost.
Water/Weather Tightness
New England Gutters Inc expects your property to be in good repair and weathertight (including electrical service, receptacles, light fixtures, doors, windows, and skylights). The company is not responsible for water infiltration resulting from poor installation, deterioration, neglect, worn/aged materials, or loose sealants/caulks.
4. Window & Glass Cleaning
Scratches & Liability
Due to issues with glass scratching during cleaning, New England Gutters Inc will not be liable for scratches on windows, sliding doors, entry doors, basement glass, mirrors, or any other glass surfaces. Razor blades and scrapers are standard professional tools used safely to remove debris (plaster, paint, tape, etc.) from quality glass, and their use may be employed.
Customer Responsibility
IT IS THE CUSTOMER'S RESPONSIBILITY TO NOTIFY New England Gutters Inc PRIOR TO COMMENCING WORK IF THERE ARE ANY WINDOW COVERINGS, COATINGS, FILMS, ETC., ON THE GLASS, OR SPECIFIC MANUFACTURER CLEANING METHODS.
Scope of Window Cleaning
Standard exterior and interior window cleaning includes all accessible glass and visible sills. Tracks and sills under the sash (open windows) are an added service at an extra charge. Large interior items such as dressers and beds will NOT be moved by our staff.
5. Water Usage & Property Courtesy
Water Supply
You agree to provide New England Gutters Inc the right to use (without compensation) an on-site water supply. It is the customer's responsibility to ensure the water supply is turned on and working before we arrive. If water is unavailable, we may provide a water supply at an additional charge for smaller jobs, but this option is restricted for large properties. Any water damage resulting from faulty, old, or leaking plumbing, spigots, or pipes will NOT be our responsibility.
Safety of Children & Pets
Customers are responsible for keeping all children and pets, as well as themselves, away from the work area, vehicles, and equipment. Children and pets should be kept off washed surfaces for at least 12–24 hours after completion.
Exclusivity of Workday
New England Gutters Inc will not provide services if there are any other companies doing work at the property on the same day. Rescheduling due to this conflict may incur a fee, and new dates are typically 1 to 2 weeks out.
Furniture Removal
Removal and replacement of grills, deck furniture, planters, toys, etc., is the responsibility of the homeowner. Should we need to move items, we will not be responsible for breakage, and an additional labor charge will apply.
6. Payments & Fees
Payment Structure
A 50% deposit is required in order to schedule a date. All remaining balances are ALWAYS due upon the date of completion of the job. Any variance to this policy must be agreed upon in writing at the time of the quote.
Late Balances & Collections
Late charges will be immediately assessed on all unpaid balances. The customer agrees to pay any and all collection costs and legal fees incurred by New England Gutters Inc relating to the collection process of outstanding balances.
7. Service Guarantees
Gutter Cleaning: Guaranteed for 30 days against overflow.
Gutter Brightening: 30-day guarantee on any new mildew, moss, or algae.
Gutter Installation & Repair: 1-year guarantee on both workmanship and materials. To extend the workmanship guarantee up to 5 years, customers must maintain their gutters with a minimum of two (2) gutter cleaning services per year performed exclusively by New England Gutters Inc.
MicroGuard Installation: 1-year guarantee on workmanship and materials. To extend the workmanship guarantee up to 5 years, customers must maintain their system with a minimum of one (1) gutter cleaning service per year performed by New England Gutters Inc.
Roof Wash Guarantee: 1-year guarantee on any new algae, moss, mold, or lichen (applies only to roof areas washed by New England Gutters Inc).
Power Wash Guarantee: 6-month guarantee on any new algae, moss, mold, or lichen (applies only to surface areas washed by New England Gutters Inc).
Window Cleaning Same-Day Rain Guarantee: If it rains the same day your exterior windows were cleaned and you feel they are not perfect, you must notify our office by the end of the following day. We will reschedule within approximately one week to re-clean affected windows (excludes hard water stains, scratches, interior condensation, or bleeding paint from old windows).
Warranty Claims & Exclusions
If you have concerns, our office must be contacted immediately upon discovery. Corrective measures will be undertaken subject to the limitations of time and scope set forth in our Warranty. New England Gutters Inc expressly disclaims any and all implied warranties, including merchantability or fitness for a particular purpose. Items beyond our control (e.g., bird droppings, soil/mulch runoff, rust, tree sap, artillery fungus, motor oil, paint/food stains) are not included in any guarantee.
8. Text Messaging (SMS/MMS) Terms
Consent
By voluntarily providing your telephone number, you expressly agree to receive recurring automated text messages (SMS & MMS) from us concerning services, offers, promotions, and transactions. Consent is not required to make a purchase. Message and data rates may apply.
Accuracy & Changes
You verify that the mobile number provided is true, accurate, and owned by you. If your contact information changes, you agree to immediately notify us by emailing sales@newenglandguttersinc.com.
Opt-Out
You may opt out at any time by replying STOP to any mobile message from us, or by emailing sales@newenglandguttersinc.com. You will receive a final text message confirming your opt-out. For help, text HELP or email us.
